Under the direction of Gitxaała Hereditary and elected leadership, Gitxaała has appealed parts of the original ruling on the Mineral Tenure Case. While the Nation’s concerns with the mineral claims have been resolved, Gitxaała is appealing the Court’s decision that the Declaration on the Rights of Indigenous Peoples Act (DRIPA) is not legally enforceable.
This is a precent setting case, not just for Gitxaała Citizens, but for all Indigenous people, as a successful appeal will ensure the Government of British Columbia can not use legislation to avert court decisions on Rights and Title cases.
We invite all Gitxaała members who are interested to observe the case on January 20th, 21st and 22nd
· For those close to Vancouver who can attend, the case will be heard in person at the BC Court of Appeal (800 Smithe St, Vancouver)
· Remotely, through a video link that will be set up in the Band Office
There will be a rally held by RAVEN on the steps of the court at the corner of Hornby St. and Nelson St. on Monday January 20th at 9 am.
